Türk Sağlık-Sen sues the Council of State for the Right to Work Part-Time for Contracted Personnel

Türk Sağlık-Sen filed a lawsuit at the Council of State because contracted personnel cannot benefit from the right to work part-time. President Önder Kahveci stated that the regulation is not humane and should cover all employees.

Türk Sağlık-Sen sues the Council of State for the Right to Work Part-Time for Contracted Personnel

Ankara - Türk Sağlık-Sen announced that it has filed a lawsuit with the Danistay in order for contracted personnel working in public institutions to benefit from the right to work part-time. The union stated that Article 2 titled "Scope" of the Regulation on the Exercise of the Right to Part-Time Work by Civil Servants contains incomplete regulation as it does not include contracted personnel, and that this situation is against the law.

"A Humanitarian Regulation, There Should Be No Discrimination"

In the petition submitted to the Council of State by the Turkish Healthcare Workers' Union, it was emphasized that the right to work part-time is a humanitarian regulation in general and is of great importance in terms of labor peace. The petition stated that the regulation in question should be applied holistically and uniformly, and that it is a requirement of the law that it should not allow any discrimination. It was stated that this deficiency in the regulation was against the law.

Rights of Contracted Personnel and Judicial Decisions

The petition reminded that the rights of contracted personnel are generally regulated by the "Principles on the Employment of Contracted Personnel" dated 1978. However, it was pointed out in the petition that judicial decisions have consistently ruled that the provisions of the Civil Servants Law No. 657 apply to the rights of contracted personnel that cannot be humanly divided due to changing modern working conditions. This supports the idea that the right to part-time work should also apply to contracted staff.

Statement by General President Önder Kahveci: "Not Human"

The President of Türk Sağlık-Sen, Önder Kahveci, commenting on the lawsuit, said, "Part-time work is the right of every parent who works in the public sector and meets the conditions." Kahveci emphasized that it is inhumane to limit or narrow this right only because of the form of employment.

Kahveci concluded his words as follows: "We are taking this issue to the legal dimension with the lawsuit we filed. We hope that an arrangement will be made to cover all employees as soon as possible." The union stated that it will continue its legal struggle to eliminate the victimization of contracted personnel and to provide them with the part-time working opportunity they deserve.
